The Probation or Pretrial Services Office intended to deliver a notification to begin his punishment to Binance’s creator, according to the article. We expected the judge to sign the document.
Contrary to this expectation, Binance Founder CZ has not yet received the information, and consequently, he has not started serving his term. As a reminder, CZ entered a guilty plea to the charges of violating the United States’ anti-money laundering laws.
According to federal statute 18 U.S.C. § 3585(a), the beginning of a criminal’s sentence occurs when the individual is “received in custody, awaiting transportation to, or voluntarily surrendering to, the official detention facility at which her sentence is to be served.”
The sentence could start immediately on the sentencing day, but three factors could delay it. A judge may first request that a sentenced individual be surrendered to the United States Marshalls.
The Marshalls would either escort the individual or alert them later, when they needed to physically report to the correctional facility. It is possible that the delay will occur in the second scenario, which is when a judge gives permission to the Probation or Pretrial Services Office to inform the defendant of their scheduled date of entry into jail.
In addition, the judge may decide to permit a defendant to voluntarily report to prison during the proceeding. Typically, the judge reserves this option for defendants with relatively short sentences or those with a low likelihood of escaping from custody.
Binance Founder received the second type of verdict because he did not face a penalty that included a multiple-year prison sentence. As a result, he is currently waiting for a notification from the Pretrial Services or Probation Office.
Before deciding whether or not to send a criminal to jail, the Bureau of Prisons is required by law to consider a variety of important factors, including the offender’s past and the resources available at the facility, among other things.
If the Bureau of Prisons fails to consider these rules, the attorneys representing a criminal may seek an appeal for a lower sentence based on due process.
To put it another way, the United States Constitution’s mandate of due process is the primary reason Binance Founder CZ is not yet in jail. The Fifth Amendment affords this protection to all individuals residing in the United States, including those who are not citizens of the country.
